Terms of use
Last updated: October 2026
1. Scope and provider
(1) These terms apply to the Gapwise app. The provider is Paul Holzhauer (PFH Studios), Herzogstraße 17, 84561 Mehring, Germany ("provider").
(2) Apple's Licensed Application End User License Agreement applies in addition. Where they conflict, these terms take priority to the extent permitted by law.
2. Services
(1) Gapwise helps you learn vocabulary and terms. You can paste, photograph, scan or import study material from PDFs and practise with it.
(2) Some features are free. More features (Gapwise Pro) are available with a subscription. The app shows what is included before you buy.
(3) The "readiness" shown in the app is an estimate based on your answers. It is not a guarantee of any result in a test or exam.
3. Subscription, free trial and prices
(1) Subscriptions are bought and billed through Apple's App Store. The price shown in the App Store before you buy is the final price you pay.
(2) A free 7-day trial may be offered for the yearly plan. It is available once per Apple ID. If you do not cancel at least 24 hours before the trial ends, the paid yearly subscription starts automatically.
(3) Subscriptions renew automatically for the chosen period (one month or one year) unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID.
(4) If you allow notifications, the app reminds you two days before your trial ends.
(5) Minors may only take out a subscription with the consent of their parents or legal guardians.
4. Cancellation
You can cancel your subscription at any time in your Apple ID settings. In the app, Settings has a "Cancel subscription" button that opens Apple's subscription management, where you confirm the cancellation. It takes effect at the end of the current period.
5. Right of withdrawal
Consumers have a statutory right of withdrawal. Details are in the withdrawal information in the app. You can withdraw in the app with "Withdraw from contract" or directly with Apple at https://reportaproblem.apple.com.
6. Your content, photos and third-party rights
(1) You are responsible for the content you add, photograph or scan.
(2) Only use photos, scans and files that belong to you or that you have the rights to use. This includes copyrighted texts such as pages from school books, which you may only use for your own studying.
(3) If people can be seen in a photo, you must have their consent first. It is best to photograph only the page with the study material.
(4) You must not use unlawful content.
(5) Your word lists stay on your device. The provider does not store or check your content. If you allow the AI feature, photos, scans and PDFs are sent to OpenAI to read the list (see section 7 and the privacy policy).
7. AI features
(1) The app uses AI to read word lists from photos, scans and PDFs (OpenAI's GPT-6 Luna) and to write example sentences and memory hooks (on iPhones with Apple Intelligence, Apple's on-device language model, otherwise OpenAI's GPT-6 Luna). Content is only sent to OpenAI if you allowed it in the app. Example sentences and memory hooks are labelled as AI-generated in the app.
(2) Lists read by the AI can be checked and corrected before you save them. Without AI, the app reads lists on the device, which may cause more mistakes.
(3) AI-generated content may be wrong or incomplete. Please check it before relying on it. It is not professional advice.
(4) If you are under 16, please only allow the AI feature that sends content to OpenAI with the consent of your parents or legal guardians.
8. Updates
(1) The mandatory consumer rights for digital products under §§ 327 et seq. of the German Civil Code (BGB) apply and are not limited by these terms.
(2) During the subscription, the provider supplies the updates needed for the app to work as agreed, including security updates.
9. Liability
(1) The provider is fully liable for damage resulting from injury to life, body or health, and for intent and gross negligence.
(2) For slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for this kind of contract.
(3) Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.
10. Intellectual property
The app and its content are protected by copyright. You receive a simple, non-transferable right to use the app for your personal studying. The icons are from Reicon (reicon.dev) under the MIT License.
11. Privacy
Information about the processing of personal data is in the privacy policy in the app.
12. Applicable law
German law applies. Mandatory consumer protection rules of the country where you normally live remain unaffected.
13. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
If any provision of these terms is invalid, the remaining provisions stay in effect.
The German version of these terms is the binding one.
